User Data Deletion Request

Overview
At Frenk.ai, we respect your privacy and your rights under the General Data Protection Regulation (GDPR) and other applicable data protection laws. As outlined in our Privacy Policy, you have the right to request the erasure (deletion) of your personal data under certain circumstances, such as when the data is no longer necessary for the purposes it was collected, you withdraw your consent, or processing is unlawful.
This page provides clear instructions on how to request the deletion of your personal data, including data collected through third-party services like Single Sign-On (SSO) providers (e.g., Facebook, Google). Note that while we aim to delete your data as requested, we may retain certain information if required by law (e.g., for tax, accounting, or legal compliance purposes), as described in our Privacy Policy.
Your Right to Erasure
Under GDPR Article 17, you can request erasure of your personal data if:
- It is no longer needed for the original purpose.
- You withdraw consent (and no other legal basis applies).
- You object to processing based on legitimate interests, and there are no overriding grounds.
- The data has been processed unlawfully.
- Erasure is required to comply with a legal obligation.
- The data was collected in relation to a child (if applicable).
This right does not apply if retention is necessary for:
- Freedom of expression or information.
- Compliance with legal obligations.
- Public health, archiving, or scientific research.
- Establishing, exercising, or defending legal claims.
For data collected via third-party SSO (e.g., name, email, profile picture), deletion will include revoking access to your linked account and removing associated data from our systems, subject to the above exceptions.
How to Request Data Deletion
Via Your Account Settings (Recommended for Registered Users):
- Log in to your Frenk.ai account at www.frenk.ai.
- Navigate to Account Settings > Privacy & Data > Delete Account.
- Select the option to request full data deletion (this will also terminate your account and any active subscriptions).
- Confirm your request and provide a reason (optional).
- You will receive a confirmation email with details of the request.
Via Email (For All Users, Including Non-Registered or SSO-Only Users):
- Send an email to [email protected] with the subject line: "GDPR Data Erasure Request".
- Include:
- Your full name and email address (or phone number) associated with your Frenk.ai account or third-party SSO.
- If applicable, your Frenk.ai account ID (found in your account settings).
- A brief description of what data you want deleted (e.g., "all personal data, including third-party SSO-linked information").
- Proof of identity (e.g., a scanned ID or other verification) to prevent unauthorized requests.
- We will respond within 72 hours to acknowledge receipt and may contact you for additional verification if needed.
- If you used a third-party SSO to access Frenk.ai, include your provider username or profile link in the request to ensure we unlink and delete the associated data.
What Happens After Your Request
- Verification: We may verify your identity to ensure the request is legitimate and protect against unauthorized access.
- Processing Timeline: We will process your request without undue delay and at the latest within one month of receipt (extendable by two months for complex cases, with notification). You will receive:
- Confirmation of receipt.
- Details on any data retained (e.g., for legal reasons).
- Confirmation of deletion once completed.
- Effects of Deletion:
- Your Frenk.ai account will be permanently deleted.
- All uploaded documents, financial data, and personal information (e.g., name, email, transaction history, AI-generated insights) will be erased from our systems, backups, and processors (e.g., hosting providers, open banking partners).
- Third-party SSO linkages will be revoked, and any synced data (e.g., profile info) will be removed.
- Access to Premium Services will end immediately (no refunds for prepaid periods, per our Terms of Service).
- Free Services access will also be terminated unless you request otherwise.
- Backups and Retention: Data may persist in secure backups for up to 30 days for recovery purposes but will be securely overwritten. Legally required data (e.g., payment records for 10 years under Czech tax law) will be anonymized or retained minimally.
- If your request is denied (e.g., due to legal retention needs), we will explain the reasons and your right to complain.
Additional Rights and Options
- Withdraw Consent: If your data processing relies on consent, you can withdraw it at any time via email to [email protected], which may trigger partial deletion.
- Data Portability: Before deletion, request a copy of your data in a machine-readable format (e.g., JSON or CSV) under your right to portability.
- Object to Processing: For marketing or legitimate interest-based processing, object via the same channels.
- Complaints: If unsatisfied, contact the Czech Office for Personal Data Protection at www.uoou.cz or file a complaint via the EU's ODR platform at https://ec.europa.eu/odr.
